Geraci Law Attorney Charles Kinzer Reports: Our client forgot that he was being sued in Iroquois County over an old debt, and he therefore forgot to list it on his petition. He was then arrested for failing to appear in court, and he was released on $500 bond. We promptly got the suit dismissed, but the Judge wanted a court order directing where to release the bond. I was able to contact the judge’s chambers directly and have them release the funds without a court order, which would have taken weeks.
Geraci Law Attorney Briana Czajka Reports: Credit Union objected to confirmation on the basis of good faith because loan was taken out 99 days before the case was filed. I discussed with the client to see what happened between loan and case filing that caused her to file case: she had medical issues which caused her to miss work and her adult children, who are not working, all moved back in. We briefed a response to the objection, demonstrating that our client did actually file her case in good faith. The judge overruled the credit union's objection.

After listening to her situation, I began to work for a solution. It turned out that she worked very close to my home. Instead of making her run around or miss work, I simply took the office to her! Our client was able to get her appointment handled with the usual stress that comes with bankruptcy preparation.

Although he is nervous about any activity that involves walking, he feels better having a plan going forward.

It was his first time using a pre paid debit card and he did not realize he had to register it before using it. I took an extra 15 minutes to help him register his card, and set him up on automatic payments to save him trips to the office. He was extremely thankful and appreciative for going out of my way.
Geraci Law Attorney Kristin Beilke Reports: Client's new employer required him to finance a vehicle for work. The deadline to submit the financing was 1/8/2016. Unfortunately, the judge did not sit prior to that date due to the holiday schedule, so we filed an emergency motion. The trustee filed a response saying she has no objection, and the judge's chambers granted the motion. We didn’t have to waste time going to court, and the client got his authorization for financing before the deadline!

Our clients then experienced a substantial decrease in income. I was able to reduce their plan term from 60 months to 44 months! Our clients are very appreciative of our continued help.

This would make her plan run longer than the five year maximum, but she wanted her tax debt paid through the plan and wanted to finish her Chapter 13. I argued successfully that based on the specifics of this case the Judge should let her case pay this debt and run longer than the maximum length of 5 years. The Judge agreed with me over the Trustee's objection and the client will finish her case completely debt free, including her new tax debt.

They claimed not to have received the notice we mailed them and would not accept her information from her over the phone. I called their corporate headquarters and demanded the legal department. After identifying myself as one of her attorneys they marked her account for bankruptcy status and promised all collection would stop.
